MANDAYA THOMAS -v- THE QUEEN
Mandaya Thomas a Bermudian national was convicted for the importation of acetyl fentanyl a controlled drug under the Misuse of Drugs Act 1972. The conviction was based on the drug being a derivative of fentanyl as per Schedule 2(e)(iv) of the Act. Thomas appealed arguing acetyl fentanyl was not a derivative of fentanyl. The Supreme Court dismissed the appeal agreeing with the lower court's interpretation.

Clarien Bank Limited v. Elizabeth Cristina Pereira Vieira DaCosta Nancy Lynn Vieira
On November 8 2016 Plaintiff obtained a Possession Order under a mortgage over property owned by the Defendants. The order was stayed until February 24 2017 for refinancing opportunities which failed. Defendants applied for a stay of execution on April 28 2017 and again on May 11 2017 for a further stay citing potential refinancing. The court found no jurisdictional basis for a non-consensual stay based on the Defendants' submissions.

The Corporation of Hamilton v. The Attorney-General The Minister of Home Affairs The Ombudsman of Bermuda
The Corporation of Hamilton challenged amendments to the Municipalities Act 1923 that allowed the government to collect wharfage fees and cancel contracts previously under the Corporation?s control claiming these were unconstitutional. The Minister of Home Affairs assumed temporary stewardship over the Corporation citing a breakdown in municipal governance which led to a legal dispute over the authority to continue litigation against the government.

The case involved a dispute over interim care and control of two minors A & B and a prohibition against the mother removing them from Bermuda. The father was granted interim care and control by an ex parte order on June 7 2016 which was challenged by the mother. The appeal court criticized the ex parte nature of the initial order and the failure to address conflicts in evidence and procedural fairness.
