Kentucky Fried Chicken's application for judicial review of the Minister's labor dispute reference between KFC and the BIU to a tribunal established under the Labour Disputes Act 1992 was refused. The court determined that the tribunal did not have the power to impose new terms on future agreements between the parties but could encourage resolution and make non-binding recommendations.

The dispute arises from the issuance of bonds by Bio-Treat partial payment leading to default statutory demands by Highbridge and subsequent legal actions to wind up Bio-Treat. The court found Highbridge not to be a creditor equitable contingent or prospective creditor of Bio-Treat dismissing Highbridge's summons to set aside a previous order restraining them from presenting a winding-up petition.

The case revolves around the second defendant's application for a review of the Registrar?s taxation of his costs of the action which were awarded following a judgment striking out the plaintiff?s claim. The plaintiff did not appear at the hearing or file notice of objections. The application for review was out of time but time was enlarged accordingly. The main issues include the reasonableness of the reductions made by the Registrar and the proper allowance of costs including whether the costs were reasonably incurred and the amounts reasonable.
