Plaintiff employed as a part-time kitchen steward injured his hand while using a freight elevator at work. Claimed negligence and breach of statutory duty by the defendants for failure to maintain elevator and inadequate training. Defendants denied citing proper maintenance and disputed the plaintiff's account of the accident.

Evidence of gang rivalry between the 42nd Street and Parkside gangs as motive. Defendants' appeals against convictions dismissed based on the strength of circumstantial evidence.

On 12 February 1994 Thomas Hofer admitted for a psychiatric condition became quadriplegic after an accident at St. Brendan?s Hospital. The accident's specifics were contested but it involved Hofer sustaining injuries while in the hospital's care.
