Fidelity National Title Insurance Company sued Trott & Duncan for professional negligence, claiming the firm failed to properly advise on the enforceability of a mortgage and guarantee related to an $18M loan given for the failed Par-La-Ville hotel project. The Plaintiff alleged that the law firm?s negligence resulted in issuing title insurance without the proper legal caveats, exposing them to financial loss. The Defendant sought to strike out the claim, arguing that no cause of action existed.

The case revolves around an application to set aside a default judgment against Burgess for failing to pay mortgage debts to First Bermuda. The judgment included payment of $2456232.50 and enforcement of the mortgage by sale. Burgess argued the loans were obtained through fraud by a project manager Nicholas Wallington alleged to be the bank's agent and possibly involving bank employees.

Plaintiffs claimed damages for fraudulent misrepresentation in the sale of a nursery school alleging misrepresentation of student numbers and the school's financial health. Defendant disputed these claims stating correct student numbers were communicated and financial health was not misrepresented
