FACTS OF THE CASE:
On November 10 2011 plaintiff Dwayne L. Brown collided with a parked taxi owned by Ervin Dean Grant and driven by Brandon Levon resulting in a fractured right tibia/fibula and a permanent partial disability. The claim was filed on February 28 2013 alleging negligence for parking on a double yellow line and vicarious liability.
SUMMARY:
Whether the parking of the taxi on a double yellow line constituted negligence the vicarious liability of the second defendant and the contributory negligence of the plaintiff.
OUTCOMES:
D1 found 100% responsible D2 not vicariously liable $36000 in general damages and $1046 in special damages awarded to the plaintiff.
