FACTS OF THE CASE:
Dessarollo a Mexican real estate company sought to enforce an Arizona Court judgment against Kader Holdings a Bermudian company based on a guarantee linked to a lease agreement. Kader Holdings challenged the Arizona Court's jurisdiction and lost then fully contested the case on merits. The Supreme Court of Bermuda ruled in favor of enforcing the Arizona judgment finding Kader Holdings had voluntarily submitted to the jurisdiction of the Arizona Court by contesting both jurisdiction and merits
