Road traffic accident on May 12 1993 caused by the defendant's negligence leading to the plaintiff's significant physical and psychological injuries and subsequent employment termination in 2005
SUMMARY:
Causation of loss assessment of damages for loss of earnings and future earnings impact of the injuries on the plaintiff's employment
OUTCOMES:
The court found the defendant liable for the plaintiff's loss of earnings and future earning capacity due to the accident awarded general damages of $100000 and refused a claim for handicap in the labour market. The plaintiff was also allowed to claim lost earnings based on the 2003 base annual earnings and was not required to give credit for disability benefits received under an insurance policy funded by himself
