The Plaintiff Carl Paiva seeks an injunction against the Defendant for a public nuisance claim related to an unsafe retaining wall on the Defendant's property posing a hazard. The wall adjacent to the public roadway Ocean Lane and opposite Paiva's properties is at risk of imminent collapse endangering users of the roadway including children. The Defendant Hamiltonian Hotel & Island Club Ltd. failed to repair the wall despite acknowledging the need.

Kiari Tucker v The Queen

On 13th June 2019 Kiari Tucker was convicted for the murder of Morlan Steede and using a firearm to commit an indictable offence. Tucker was sentenced to life imprisonment for the murder with a recommendation of 25 years before eligibility for parole and 10 years' imprisonment for using a firearm to run consecutively. The appeal focuses on both conviction and sentence. The facts involve Tucker after premeditation chasing and fatally shooting Steede on 3rd November 2017. CCTV footage captured the chase and shooting. After the murder Tucker made an 83-second call that coincided with a group outside Spinning Wheel night club receiving news about the murder. Tucker was arrested the next day. Forensic evidence linked Tucker to the murder including gunshot residue particles on his hands and clothing. A forensic gait analysis expert testified to the similarities in gait between Tucker and the assailant captured on CCTV.
