Kentucky Fried Chicken (Bermuda) Limited v. The Minister of Economy Trade & Industry and The Bermuda Industrial Union Supreme of Bermuda
Kentucky Fried Chicken (Bermuda) Ltd. (KFC) applied for judicial review of the Minister?s decision to refer its dispute with the Bermuda Industrial Union (BIU) to the Labour Disputes Tribunal under the Trade Disputes Act 1992. KFC argued that no "labour dispute" existed as defined by the Act because their Collective Bargaining Agreement (CBA) had expired, and no transitional provisions were in place. They contended that the Minister's decision was unlawful and infringed upon their constitutional rights. The BIU, however, claimed that KFC?s actions undermined workers? rights and required intervention.
