The parties were married on 29 October 1994 cohabited until approximately September 2005 and divorced with decree nisi pronounced on 31 March 2006 and made absolute on 16 May 2006. Post-separation they lived separately within the matrimonial home with the husband leaving around end of July/August 2006. They have two children. The wife works as an underwriter and the husband is a businessman with interests in several companies. Cross applications for ancillary relief were filed by both parties leading to extensive affidavits and interlocutory applications. Issues arose concerning trust assets settled by the husband particularly whether these assets form part of matrimonial assets or constitute a financial resource available to the husband.
