S v S (Access to Child Abroad - Jurisdiction)

The Appellant (Mother), residing in the UK with her 10-year-old child, challenged a Family Court ruling that continued to recognize Bermuda's jurisdiction over access matters. The child was born in Bermuda in 2000, but had lived abroad with the Mother since 2007. The Father sought an order requiring the Mother to pay 50% of access-related travel costs, arguing that Bermuda courts retained jurisdiction. The Family Court ruled in his favor, citing the original custody order issued in 2001. The Supreme Court had to decide if Bermuda retained jurisdiction despite the child's habitual residence abroad.

BNY AIS Nominees Limited et al. v. Stewardship Credit Arbitrage Fund Ltd. Supreme of Bermuda

Investment funds managed by the Gottex Group sought a winding-up order against Stewardship Credit Arbitrage Fund Ltd. (the ?Fund?) due to alleged insolvency. The Plaintiffs had invested in the Fund through Class A shares, later attempting to redeem their investments. The Fund failed to pay the redemption sums, offering participation notes instead. The Plaintiffs argued that the Fund was commercially insolvent and sought the appointment of joint liquidators.

Gardner charged with premeditated murder of Malcolm Augustus on 25 December 2012 convicted and sentenced to life imprisonment with a 20-year tariff appeal against conviction dismissed appeal against sentence for murder 1 successful leading to retrial challenge to jury selection process under section 519(2) of the Criminal Code as unconstitutional

Wendell Hollis and Joseph C.H. Johnson v. Alexander Scrymgeour

John Scrymgeour advanced funds for the purchase of Greensleeves Cottage by forming a trust Interior Trust with his son Alex as the beneficiary to utilize Alex's Bermudian status. The property was intended for John's use until his death after which Alex was to inherit it. No loan documents were executed leading to a dispute on whether the funds were a loan or a gift to the trust.

The Court had to determine an appropriate maintenance order considering the Husband?s earnings and the Wife?s financial needs
