The Supreme Court of Bermuda
Civil
BERMUDA BRED COMPANY v THE MINISTER OF HOME AFFAIRS AND THE ATTORNEY-GENERAL
Bermuda Bred Co., a company advocating for equal rights, challenged the Bermuda Immigration and Protection Act 1956, arguing that same-sex partners of Bermudians were unfairly denied the same rights as heterosexual spouses under immigration law. The company sought judicial review, claiming that this policy was discriminatory under section 5 of the Human Rights Act 1981. The government attempted to strike out the case, arguing that the company lacked standing and that the Immigration Act was not subject to human rights law. The court had to determine whether the Human Rights Act had primacy over the Immigration Act and if same-sex partners should be granted equal residency rights.
