Phoenix Global Fund Ltd. et al. v Citigroup Fund Services (Bermuda) Ltd. et al.
Phoenix Global Fund Ltd. and Phoenix Capital Reserve Fund Ltd. sued Citigroup Fund Services (Bermuda) Ltd. and The Bank of Bermuda Ltd. over the alleged mismanagement of investment funds leading to significant financial losses. The plaintiffs sought around $40 million in damages, claiming breach of fiduciary duty and negligence in fund administration. The defendants applied for security for costs, arguing that the plaintiffs were "nominal plaintiffs" with no independent assets, making them unable to pay any adverse cost orders.
