THE COMMISSIONER OF POLICE -v- THE PUBLIC SERVICE COMMISSION and OSWIN PEREIRA

A police officer PC Oswin Pereira pursued tased and arrested a suspect Talundae Grant turning off his body camera before allegedly assaulting the suspect. Despite being found not guilty in court disciplinary proceedings were initiated for gross misconduct. The disciplinary panel recommended dismissal but the Public Service Commission overturned this decision imposing a final written warning instead. The case involves issues of operational dishonesty the suppression of evidence and the integrity of police officers in investigations.

She argued the process was flawed and her acting appointment and subsequent non-appointment violated her legitimate expectation to be substantively appointed
