The Director of Public Prosecutions initiated disciplinary proceedings against the Deputy Director Cindy Clarke alleging gross misconduct. Clarke challenged this for apparent bias. The Supreme Court found bias and remitted the proceedings to the Permanent Secretary but the Court of Appeal reversed this decision allowing the Director's appeal on grounds of necessity and non-delegable duty without actual bias.
